Guyana’s procurement framework provides administrative review for specified procurement complaints. The route and deadline depend on the decision, timing and complainant’s position.

The governing Act and Regulations contain differences that should not be converted into one universal protest procedure. Obtain qualified advice immediately when a live deadline is running.

Confirm standing and the challenged action

Section 52 of the Procurement Act gives standing to a bidder whose tender or proposal was rejected to challenge a procuring-entity decision or action alleged not to comply with the Act. The statutory route excludes a Cabinet decision within its stated boundary.

The Regulations use broader supplier-or-contractor loss or possible-loss language. That difference remains unresolved and should not be used to broaden the statutory right without legal analysis.

Identify the correct review route

The Regulations distinguish complaints first reviewed by the procuring entity from specified complaints made directly to the Bid Protest Committee through the Administration.

Do not send the same generic complaint to every body. Identify:

  • the challenged decision or action;
  • whether a contract has entered into force;
  • the applicable Act or regulatory route; and
  • whether prior procuring-entity review is required.

Act within the applicable deadline

The Act and Regulations contain separate route-specific intervals, including a five-business-day period following publication of the award decision and a seven-working-day awareness-based period in the regulatory route.

These are not one universal deadline. A dissatisfied complainant may also face a short escalation interval after the procuring entity’s decision or failure to decide.

Prepare the complaint content

The Regulations require the complaint to identify:

  • the complainant and procurement proceedings;
  • the alleged breach;
  • the supporting facts; and
  • the requested remedy.

The complaint must be delivered to the Administration, accompanied by the required registration fee and copied to the procuring entity under the regulatory route.

No current universal official form, filing address, file specification, payment channel or exact fee amount was established in the controlled sources. Confirm these directly before filing.

Review and hearing

After checking the fee and copy requirements, the Administration passes the complaint to the committee chair. A frivolous complaint may be dismissed and the registration fee may be lost.

The committee can review written submissions or conduct a fair hearing. It must proceed urgently and make every effort to decide within ten working days after receipt, but that is an effort target rather than a guaranteed service deadline.

Decisions, remedies and suspension

The framework provides for a written decision and potential dismissal, corrective action, compensation and termination remedies. Under the Act, damages are limited to bid-preparation costs.

Suspension rules apply subject to their conditions. Suspension is not automatic in every case, and the Regulations provide a public-interest certification exception supported by written grounds.

The committee decision is administratively final and immediately binding on the procuring entity. That does not establish that judicial review is excluded.

Protest-preparation checklist

  1. Preserve the solicitation, bid, receipt, notices and public award record.
  2. Identify the precise decision and alleged breach.
  3. Calculate every potentially applicable deadline conservatively.
  4. Confirm the proper route and filing requirements.
  5. State the facts, breach and requested remedy clearly.
  6. Copy the procuring entity where required.
  7. Obtain and retain proof of filing, payment and delivery.
  8. Do not assume filing automatically suspends the procurement.
